Terms of Service — Jessya
1. Acceptance and Legal Capacity
By accessing or using Jessya (the "App" or the "Service"), whether on mobile (iOS, Android) or on the web (jessya.com), you accept these Terms in full. If you do not agree, you must not use the App.
Jessya is provided by Wycro Software Developers CIA. LTDA., an Ecuadorian company registered with the Superintendencia de Compañías, Valores y Seguros. The App is a guided Catholic prayer platform, available in several languages.
Capacity: you must be at least 13 years old to use Jessya. If you are under 13, Jessya is not permitted to you in any jurisdiction. If you are between 13 and 18, please make sure a parent or legal guardian has reviewed these Terms — some jurisdictions require explicit parental consent up to a higher age (for example 15 in Ecuador under the LOPDP, 16 in some EU countries under the GDPR, and 14 in Quebec under Law 25). 2. Description of the Service
Jessya offers:
- Guided audio prayer — morning prayer, the Rosary, the daily Gospel, family prayers and multi-day plans
- A prayer community — share intentions and pray for others
- Personal reminders — morning, midday, evening, the Angelus
- A content library — the Bible, reflections, the liturgical year
- Progress tracking — completed prayers and streaks
"As is" service: Jessya is provided "as is" and "as available". We work to keep the App stable, but we do not warrant that it will be free of errors or interruptions, that your connection will not fail, or that the servers will be available 24/7 without maintenance.
Changes to the App: Wycro may modify, suspend or discontinue features, change pricing plans or promotions, and carry out maintenance — though we will try to give notice.
Use of artificial intelligence: Jessya uses AI for specific functions, including automated moderation of prayer intentions (Section 3.3), the optional user-content translation feature, and AI-assisted drafting of daily reflections and saints' biographies that our team reviews before publication. By using these features you acknowledge that some output is generated by AI systems, is provided "as is", and must not be treated as infallible medical, psychological, legal or doctrinal advice (see Section 5.1). What data the AI processes is described in the Privacy Policy.
3. Responsible Use
3.1 Permitted conduct
You agree to use Jessya only for lawful and legitimate purposes: personal prayer and Catholic practice, participation in the prayer community, and reading spiritual content.
3.2 Prohibited conduct
You must not:
- Attempt to gain unauthorised access to Jessya's servers, databases or code
- Introduce viruses, malware or malicious code
- Harass, insult, threaten or defame other users
- Post pornographic, violent or exploitative content
- Post content promoting hatred, discrimination or violence
- Post content that infringes anyone's copyright or intellectual property
- Attempt to obtain paid access without paying
- Sell, resell or transfer your account
- Automate access using bots or scripts
Consequences: breaking these rules may lead to suspension or permanent deletion of your account, loss of access to your content, and referral to the authorities where the conduct is unlawful.
3.3 Zero tolerance for objectionable user content
Jessya has zero tolerance for objectionable content and abusive users in prayer intentions and other user-generated content ("User Content"). By posting User Content you accept that it may be filtered, hidden or removed without prior notice, and that your account may be suspended or permanently deleted.
Posting anonymously hides your name from other users, but it does not remove your responsibility for the content and does not prevent Wycro from identifying the author internally for moderation purposes.
Some moderation decisions are automated. Where that is the case you have the right to ask for a human review — see Section 3.4 and the Privacy Policy.
3.4 Automated moderation and your right to human review
Content may be hidden automatically after it accumulates reports, and accounts carry an internal trust score that can subject your posts to stricter automated review. These decisions can significantly affect the visibility of your content.
You may ask us which factors were applied to your case, submit your own observations, and request that a human being review any automated moderation decision, by writing to abuse@wycro.com. If you are a Quebec resident this right is guaranteed by section 12.1 of Law 25.
4. Content and Intellectual Property
Prayers, audio recordings, reflections, artwork and software in Jessya are owned by Wycro or licensed to it, and are protected by copyright. Liturgical and scriptural texts remain subject to the rights of their respective publishers and translators.
Your content: you keep ownership of the intentions and other User Content you post. You grant Wycro a non-exclusive, worldwide, royalty-free licence to host, display and distribute it inside the Service for the purpose of operating the prayer community. That licence ends when you delete the content, except where others have already interacted with it — see Section 4.2.
You are responsible for confirming that anything you post is yours to post and lawful to publish where you live.
4.1 Copyright notice and takedown
We respect third-party intellectual property. Rights holders (or their authorised agents) who believe in good faith that User Content infringes their rights may send a notice to our designated agent under the United States Digital Millennium Copyright Act (DMCA, 17 U.S.C. § 512): dmca@wycro.com.
4.2 What happens to your content when you delete your account
When you delete your account we permanently delete your personal records. Community intentions and support prayers you authored are anonymised rather than destroyed, because other people prayed for them and removing them would erase part of someone else's prayer history. Anonymised intentions carry no link back to you.
5. Disclaimers and Limitation of Liability
5.1 Jessya is spiritual, not medical
Jessya is NOT a medical, psychological or mental-health service. Prayers and reflections are for spiritual purposes only. They do NOT replace medical care, therapy or professional counselling. If you are experiencing a mental-health or medical crisis, contact a medical professional or emergency services immediately. In Canada and the United States you can call or text 988 (Suicide Crisis Helpline), or 911 in an emergency.
5.2 General limitation of liability
To the extent permitted by law, Wycro is not liable for:
- Direct or indirect damages: loss of data, loss of profit, business interruption, emotional distress
- App errors: incorrect content, interrupted audio, failed notifications
- Service interruptions: maintenance, cyberattacks, internet failures, natural disasters
- The conduct of other users: insults, harassment or offensive content in the community
- Loss of your account through a forgotten password, a stolen device, or a breach of these Terms
EVEN IF WE HAVE BEEN ADVISED of the possibility of such damages.
Legal limits on these exclusions. Nothing in this section excludes or limits our liability where the law does not allow it. In particular, if you reside in Quebec (Canada), under article 1474 of the Civil Code of Québec we do not exclude or limit liability for bodily or moral injury, or for intentional or gross fault. If you reside in another Canadian province, the statutory consumer guarantees you cannot waive remain in force despite Section 5.3.
5.3 Disclaimer of warranties
Jessya is provided WITHOUT WARRANTIES OF ANY KIND, express or implied, including merchantability, fitness for a particular purpose, security, and accuracy — subject always to Section 5.2 and to consumer guarantees that cannot be excluded by law.
6. Payments and Subscriptions
Jessya's prayer content is free. There is no paywall and no trial. We offer an optional way to support the project financially; supporting is voluntary and unlocks no otherwise-restricted prayer content.
Billing: payments are processed by Apple, Google or RevenueCat, not by Wycro directly. We never receive or store your full card number.
Renewal and cancellation: where a contribution recurs, the renewal period and price are shown before you confirm. You can cancel at any time through your Apple or Google account; cancellation stops future renewals. Refunds are handled under the policies of the store that took the payment.
Contributions are not charitable donations for tax purposes, and Wycro is not a registered charity in Canada, the United States or the United Kingdom. No tax receipt is issued.
7. Privacy and Data Protection
How we handle your personal information — including religious and health-related information, which we treat as sensitive — is set out in the Privacy Policy, which forms part of these Terms. It also contains the Canada-specific section covering PIPEDA, Quebec Law 25 and CASL.
8. Changes to These Terms
Wycro may update these Terms. Material changes will be notified by email to your registered address, by an in-app notice, and by publication at jessya.com/en/terms.
If you continue using Jessya after notice, you accept the updated Terms. If you disagree, stop using the App and delete your account.
Quebec residents (Canada): acceptance by continued use does not apply to you. Under article 11.2 of the Consumer Protection Act, we will send the amendment notice in a separate document, at least 30 days in advance, setting out the new and former clause, the date the change takes effect, and your right to refuse the change and rescind the contract at no cost until 30 days after it takes effect.
9. Governing Law and Disputes
These Terms are governed by the laws of Ecuador, and disputes will be resolved in the courts of Quito, Ecuador, except where the law of your place of residence reserves that jurisdiction to your own courts on terms you cannot waive — see Section 9.1 if you are in Canada.
This governing-law and forum clause does not replace or limit the data-protection rights your own country grants you on a non-waivable basis. You may complain directly to your local authority regardless of this clause.
9.1 Canadian residents
If you are a consumer resident in Canada, nothing in these Terms limits the rights your province's consumer protection legislation gives you on a non-waivable basis, and in particular:
- You may sue in your own province. The Quito forum clause does not prevent you starting or continuing proceedings in the courts where you live where the law allows it.
- Quebec: under article 11.1 of the Consumer Protection Act, no clause requiring you to arbitrate, preventing you from going to the Quebec courts, or depriving you of participation in a class action may be set up against you.
- Ontario: under sections 7 and 8 of the Consumer Protection Act, 2002, you keep the right to sue and to participate in a class proceeding, despite any clause to the contrary.
- British Columbia and other provinces: you keep the non-waivable rights your applicable consumer legislation gives you.
Where Section 9, Section 10.2 and this Section 9.1 conflict, for consumers resident in Canada this Section 9.1 prevails.
10. Dispute Resolution
10.1 Complaints process
Write to support@wycro.com describing the problem, what happened and what you expected. We will respond within 15 business days and work with you toward a fair resolution.
10.2 Arbitration and class-action waiver
If Section 10.1 does not resolve the dispute, you and Wycro agree that disputes arising out of these Terms or the Service will be resolved by binding, individual arbitration before the Cámara de Comercio de Pichincha (Quito, Ecuador), and you and Wycro waive any right to a jury trial and to participate in a class action or consolidated proceeding.
Exceptions: this clause does not apply to (i) claims that may be brought in small claims court or its local equivalent, (ii) urgent injunctive relief protecting intellectual property, or (iii) any right or claim which, under the law of your country of residence, cannot validly be submitted to mandatory arbitration or class-action waiver before the dispute arises — including certain consumer rights under European Union and Brazilian law, and, expressly, those of consumers resident in Canada: see Section 9.1, which excludes mandatory arbitration and class-action waiver for Quebec, Ontario and other provinces to the extent their law so provides.
Severability: if a competent authority determines that the class-action waiver does not apply to a particular dispute, that dispute will be resolved in the courts of Quito, Ecuador under Section 9 (subject to Section 9.1), and the remainder of this Section 10.2 remains in force.

12. Final Acceptance
By using Jessya you confirm that you have read and understood these Terms and the Privacy Policy, and that you accept them. If you do not accept them, please do not use Jessya.
